Therefore, we strive to process your personal data in accordance with the principles defined in the data protection legislation applicable in Romania, including Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("GDPR"). The terms used in this confidentiality policy, which are not defined, will have the meaning given by the GDPR.

In the context of the interaction with Motric, you can be subjected - as an individual - to the data processing activities we perform. Therefore, we use your personal data in the following cases:
We use your relevant personal data to prepare and provide the requested Services. For example, in order for Motric specialists to prepare the most effective exercise program for the purpose set and transmitted by you, we will need at least the following personal data: date of birth and age, weight, height, sex, medical diagnosis, pelvic and waist circumference, images and/or videos with you. In this case, we rely on the execution of the contract as a basis for the processing of personal data, because without the above data we will be unable to provide you with the Services, and the use of the Platform will not achieve its purpose.

We use the contact details, namely last and first name, email, telephone, to communicate with you in connection with the requests you have, as well as with any other relevant aspects related to the business relationship. Also, in this case, we rely on the execution of the contract as a basis for the processing of personal data.

We may process some of your personal data in the context of providing the Services based on legal obligations, respectively the personal data necessary for the preparation of invoices for Services and access to the Platform - surname and name, home address, personal numerical code. We may also use your contact information to provide you in the form of your choice (electronic by email, SMS, on paper) - our offers and other information about services and products, promotions etc. of Motric, only if you have expressly requested such a service and, therefore, you have given your prior express consent to such processing of your data. In all cases, the data is provided either directly by you or by the customer/partner. The categories of data processed in the context of our relationship with you are your surname, name, email address, telephone, fax, position within the company, as well as other personal data provided to Motric, usually by you, as it is necessary for the fulfillment of the above purposes.
We use the personal data contained in the CVs we receive to assess applicants' qualifications for a position within Motric, including a position in our internship programs. We base the processing of personal data on your consent expressed with the submission of the CV and, subsequently, on the basis of the conclusion and performance of the individual employment contract.
The categories of data processed in the context of our relationship with you are surname, name, email address, telephone, fax, address, personal data included in CVs, details about education and training, professional qualifications, and other personal data that you may provide to us directly.
We use your personal data to ensure the security of our premises, assets, personnel and other Motric visitors. In this case, the data processing is based on the legitimate interest of Motric, namely the protection of these premises, assets and personnel.
The categories of data processed in this context are your surname, as well as other personal data that you may provide to us directly. Also, in this context, we mention that Motric records through the internal video surveillance systems (CCTV) images from the premises and common areas of the office premises used by Motric, images that will be kept for a period of 30 days.

We may also receive your personal data from other sources, even if you do not provide it to us directly, from third parties who have a legal right or obligation to share your data with us. We do not process your personal data for secondary purposes other than those for which it was originally collected, without prior consent, without a legitimate interest or without a legal basis.
Motric collects personal data of children only within the Services requested by the parent or legal guardian and processes them only with his/her consent.
Motric reserves the right to refuse to provide the Services without the consent of a parent or legal guardian.
In certain circumstances, we will share personal data with third parties:
● Third-party service providers - – we may use service providers to process your personal data on our behalf. We assure you that we have signed personal data processing agreements and confidentiality clauses with all third party service providers to protect the personal data and we do not allow them to be used for any other purpose.
● Competent authorities – in the case of grounded requests based on legal provisions, we provide your data to the competent authorities, when it is strictly necessary to detect fraud, criminal acts and, in general, when the legal provisions require us to comply with such a requirement.

● Where disclosure is necessary to settle disputes, to establish or exercise a right in court.
We assure you that we do not alienate or sell your personal data to any other entity, individual or legal entity.
We limit the storage time of your personal data to what is necessary for the processing purposes that have been brought to your attention.
We review the need to retain your personal data. Every 2 years we analyze the data collected and processed, in order to filter, sort and maintain the processing only for the data for which the purpose of the processing is current. If the regular review reveals that you have not used the Platform and/or the Services for the past two years, Motric will send you an email to reactivate the business relationship. If you do not respond to the Motric request, we will proceed to erase both the personal data processed and the User Account.
Regardless of your activity on the Platform, we will erase your personal data immediately, following a request sent by you, except for the data whose processing/supply is required by law, in which case the retention period will be as provided in the mandatory applicable law.
At the same time, it is possible to keep personal data in case of finding, exercising or defending a right in court.
If the retention of your personal data is necessary for the purposes specified by law, we may still retain this data.
In accordance with applicable law, we have defined and use internal procedures to prevent unauthorized access and misuse of personal data.
We use appropriate systems and procedures to protect and secure your personal data, in particular to prevent unauthorized/illegal processing, accidental or unlawful loss, accidental or unlawful destruction.
We have implemented measures to prevent and/or detect security breaches, to document security incidents to the data affected by such incidents, to remedy security incidents, to recover personal data.

In the case of our employees, contractors, suppliers and Motric collaborators, we limit and restrict their access to the personal data we process, to what is strictly necessary, on the one hand, and on the other, imposing strict confidentiality obligations.
We have also implemented and are pursuing a policy of continuous training of our personnel in connection with the processing of personal data.
Every year, we conduct an audit of the management system in order to improve the protection and security of the personal data we process.
We do not transfer your personal data to countries outside the European Economic Area or to international organizations.

All Requests will be taken into consideration and will receive a response from Motric, even if they are unfounded. The response will be adapted according to the measures taken, and if the request cannot be complied with, the refusal will be grounded.
Motric will not charge any fees or other material benefits for the exercise of the rights conferred by GDPR. An exception will be made in the case of repetitive or excessive requests, in which case we may charge a reasonable amount, but we will inform you of this before the requests are settled.
The response to requests will be sent within a maximum of 30 days of receipt. If the complexity or excessive volume of information requires a longer time, we will inform you about this within 30 days, with the actual response being communicated within a maximum of 60 days.
If the request concerns personal data for which Motric has the quality of processor, the respective request will be sent within 3 working days to the operator responsible for the respective processing. Under no circumstances will Motric respond to the data subject in the situations in which it acts as a processor, but will assist in formulating the response, if the operator so requests and will make every effort to ensure that the response reaches the data subject.
Do not provide your personal data to Motric through other communication channels, except those mentioned in this policy, respectively through the Platform User Account and/or by email at office@motricrecovery.com, regardless of the person or company that would request them on our behalf, including Motric employees or former employees you have previously met. The personal data transmitted through any other communication channels except those mentioned in the policy to any third party, for any purpose, do not fall under the responsibility of Motric, the latter not being able to ensure their security. In this regard, we encourage you to carefully study the privacy policies of such third parties.
